Pro Se Forms

Important Notice Regarding Self-Representation: While it is always preferable to seek legal counsel when involved in any legal matter, the court provides these self-help forms as a resource to assist members of the public who choose to represent themselves. Please be aware that if you proceed without an attorney, you are still responsible for following all applicable laws, court rules, and the rules of evidence and procedure. Court staff cannot provide legal advice or interpret the law on your behalf. These forms are intended as a helpful tool, but they do not replace the guidance of a licensed attorney.
Domestic Violence Protection Orders: While individuals have the legal right to represent themselves in filing a petition for a Domestic Violence Protection Order, it is strongly recommended that you seek assistance from the Tribal Domestic Violence Assistance Department. Their advocates are trained to help ensure that your petition is complete, accurate, and includes the necessary information to help the court understand your situation. Navigating the legal system can be overwhelming, especially during a time of crisis. These advocates can provide support, explain the process, and help protect your rights and safety.
With the adoption of the new code, the Fort Berthold District Court no longer has authority to issue Restraining Orders except in cases involving domestic violence, divorce, criminal charges, or as part of a civil complaint.
If your petition does not fall within one of the categories listed above, the Court no longer has a legal avenue to issue a restraining order.
Please consult an attorney to assist you in knowing whether filing a civil complaint is the right avenue for you. In general, people file civil complaints when they believe they have been harmed in some way and want the court to step in and provide a legal remedy. It is how someone informs the court: “here is what happened, here is who I believe is responsible, and here is what I am asking the court to do about it.” A civil complaint is used for such things including, but not limited to, recovering money for damages or losses, to enforce a contract or agreement, to stop harmful behavior, to resolve disputes over property, etc.

“3-10-18.1 A person is guilty of a Class 1 Misdemeanor if he intentionally places or attempts to place another human being in reasonable fear of physical injury, serious bodily injury, or death by: a Displaying a deadly weapon, dangerous instrument or what appears to be a pistol, revolver, rifle, shotgun, machine gun, or other firearm in a threatening manner; or b Verbally threatens harm to another human or engages in a course of conduct or repeatedly commits acts over a period of time with the intent to cause him reasonable fear of physical injury, serious bodily injury, or death.”
